Protecting Personal and Private Information
on Tuesday, January 24, 2017 by Sarah Kathryn WrightThe Driver’s Privacy Protection Act, or DPPA, is a federal law that protects the personal and private information that is included in a person’s motor vehicle record. The information found in ADD’s DMV123 record searches, such as vehicle owner’s names and addresses, are protected by the DPPA regulations, and in order to be able to access this search through ADD, a business must have a “permissible use” for the data. A permissible use means that a business or “authorized recipient” is only allowed to access the information for one of a specific set of reasons defined in the DPPA rules.
Without a permissible use under the DPPA, a business cannot search these records. Both ADD and states agencies audit the DPPA searches performed through DMV123 to verify the permissible uses indicated by a user at the time a search is performed. It is a violation of federal and state law to use the DMV database to access this protected data without a permissible use, and an unauthorized search can result in liquidated damages of not less than $2,500.00 per inquiry. That’s why each user on a ADD account with DMV123 access MUST have their own username and password – and why you don’t want a co-worker or employee to perform inappropriate searches using your account login information.
